JustGains Terms of Service

By using JustGains, you're agreeing to these Terms and our Privacy Policy. If you don't agree, please don't use our app.

We may update these Terms from time to time. We'll notify you of any significant changes via email or through the app. Your continued use of JustGains after changes means you accept the new Terms.

3.1 Account Creation

You need to create an account to use JustGains. Please provide accurate information and keep it up to date.

3.2 Account Responsibility

You're responsible for maintaining the confidentiality of your account and password. Please notify us immediately if you suspect any unauthorized use of your account.

3.3 Acceptable Use

Please use JustGains responsibly. Don't:

• Violate any laws or regulations

• Infringe on others' rights

• Harass, bully, or intimidate others

• Post false or misleading information

• Attempt to gain unauthorized access to the app or its systems

4.1 Content Sources

The content on JustGains, including exercises, videos, and descriptions, comes from two main sources: content submitted by our community members ("User Content") and content curated or created by JustGains ("JustGains Content").

4.2 Your Content Rights & License

You retain ownership of the User Content you post on JustGains. By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and providing the JustGains service.

4.3 Your Responsibility for Your Content

You are solely responsible for the User Content you post. You represent and warrant that you have all necessary rights to post your User Content and that it does not violate any laws, infringe on any third-party rights (including intellectual property rights and privacy rights), or violate these Terms.

4.4 Our Right to Remove Content

We reserve the right, but do not have the obligation, to review and remove any User Content or JustGains Content that violates these Terms or that we, in our sole discretion, find objectionable or inappropriate.

5.1 Sharing is Encouraged (With Attribution)

We love it when you share! You are encouraged to share links to exercises or other content from JustGains on social media or your personal website, provided you link back to our site and give clear attribution to JustGains or the creator in the content if applicable.

5.2 Prohibited Uses - Please Don't Scrape or Misuse Data

While sharing links is great, the following actions are strictly prohibited without our explicit prior written permission:

• **Scraping:** Automatically or manually collecting large amounts of data from JustGains (including exercise details, videos, images, muscle diagrams, user data, etc.). We know it's not hard to do, but please respect our platform and community efforts by not doing it. Instead, just reach out.

• **Unauthorized Use:** Using JustGains Content or data (including exercise information, character models, interactive muscle diagrams, etc.) for commercial purposes, to train machine learning models, or within other applications or services.

• **Re-hosting:** Hosting our videos or images directly on your own servers or services.

Violation of these terms may result in suspension or termination of your account and potential legal action.

5.3 Collaboration & Alternative Uses - Let's Build Together!

We believe that sharing is caring, and we're genuinely interested in building cool things together. If you have ideas for using JustGains data or content in innovative ways that go beyond simple sharing, please reach out to us! Contact us at collab@justgains.com to discuss your ideas. We're open to figuring something out.

Excluding User Content (for which you retain ownership as described above), JustGains and its original content (JustGains Content), features, functionality, branding, and underlying technology are owned by The Just Super Human Foundation and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not use our branding or trademarks without our prior written permission.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and share your information. Our Privacy Policy is incorporated by reference into these Terms.

We may terminate or suspend your account and access to JustGains at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease.

JustGains is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by applicable law, The Just Super Human Foundation, its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; or (d) unauthorized access, use, or alteration of your transmissions or content.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

We reserve the right to withdraw or amend JustGains, and any service or material we provide via JustGains, in our sole discretion without notice. We will not be liable if for any reason all or any part of JustGains is unavailable at any time or for any period.
